Simple layer problem

Hi,

I have try to work this out for the last couple of hours to no avail.

I'm designing a site that uses a graphic as a header:

and i want use a layer that i can position over the graphic that will have text in it relative to the page, i.e:

However, when i position the layer, it displays differently in FF and IE because IE7 displays a horizontal scrollbar regardless of whether the page needs one or not, thus, in IE the position of the layer in knocked out of line to compensate for the thikness of the scrollbar.

Any suggestions?
