Excellent, and I even figured out a way for it to be at the bottom.

Basically, you're going to want to wrap everything you have in a new DIV, then use the sticky footer method on that DIV so that it has a 100% height, and then ignore the footer part. Then set that DIV's background to red. The red may show through some other main containers, in that case just set those containers backgrounds to white. Then you'll have the illusion like faux columns that it goes all the way down.

And for a complete post, if you were to want your footer at the bottom, then you could set that new DIV to position:relative, and then set your footer to position:absolute;bottom:0;

hehe too faux for me nah i really need the div itself to grow for this to work. ( it has to do with some of the jquery animations on a later stage).

You are verry creative tho i like that kudo's to you

ill drop the matter for now. if you may think of something not javascript then im open for it hehe

I'm pretty sure there isn't a way to do it without JS unless you use that method.

However, IDK if you considered this, but the height of the footer won't affect the way it works. ONLY if the height of the screen is greater than the page and the footer will it come into play, if not then you won't ever see it.
That is why the "red" DIV goes around everything, so it's only used when necessary.
